In response to Nichia Corporation’s press release posted on July 16, 2015, Everlight clarifies that all claims of Nichia’s EP 936682 (DE 69702929) patent have been declared invalid by the German Federal Patent Court. The infringement action on this patent has been stayed by the German Düsseldorf appellate court. 

On the paused infringement action, Nichia recently requested the court to add new allegations that Everlight’s products also infringe its EP 2197053 patent.  Such patent is in the same family of the EP 936682 and of the U.S. Patent Nos. 5998925 and 7531960, of which all claims have been found invalid.  Everlight therefore believes Nichia’s attempt to add EP 2197053 patent is feeble and such patent shall be found invalid as well.

Nichia’s recent injunction technique and other attempts before the German court are not final dispositions by the court.  Everlight will continue to oppose and defeat Nichia’s unreasonable allegations.
