Nichia Files YAG Patent Lawsuits in Brazil

Japanese LED manufacturer Nichia reported that it has filed patent infringement lawsuits in Brazil for its YAG patent.

Since Nichia’s Brazilian YAG patent has not expired and is still in force, the company filed two patent infringement lawsuits in the Judicial District of the Capital of the State of São Paul on November 13, 2019 against two Brazilian distributors, Karimex and Arrow, who sell Everlight’s LED products. At the same time, Nichia also accused ASUS Do Brasil, a Brazilian affiliate of ASUSTek, of infringing its YAG patent.

In the lawsuits against Karimex and Arrow, Nichia claims that the two companies infringe Nichia’s Brazilian YAG patent PI9710792-1, seeking an injunction and damages caused by the accused infringement.

Meanwhile, Brazilian affiliate of ASUS was also accused of infringing the same YAG patent. The products that Nichia accuses in the lawsuit are light emitting diodes present in mobile phones Zenfone 3, Zenfone 3 Max, Zenfone 3 Zoom and Zenfone Max Pro M1.

Nichia continues legal actions guarding its YAG patent around the world. Until November 2019, the company successfully confirmed the YAG patent EP 0 936 682 (DE 697 02 929) in Germany against HTC and Everlight. However, its patent in Australia and the U.S. was ruled invalid in the lawsuit against Everlight.
