On Oct.19, 2016 and Oct. 28, 2016, Nichia Corporation (“Nichia”) filed a request for three preliminary injunctions in Germany at the Düsseldorf District Court against Everlight Electronics (“Everlight”), alleging that the white LED products “334-15/X1C5-1QSA”, „334-15/T2C2-1TVB“ and „XI3535-KT577J1-03201-000P“ manufactured by Everlight and distributed in Germany infringe Nichia's YAG patent EP 936 682 (DE 697 02 929).
The Düsseldorf District Court admitted Nichia's arguments that the above-mentioned products of Everlight infringe claim 1 of Nichia's YAG patent and granted the preliminary injunctions on Oct. 24, 2016 and Nov. 7, 2016, respectively (File Nos. 4a O 104/16, 4a O 112/16 and 4a O 113/16). Due to the particular urgency, the preliminary injunctions were granted ex parte, i.e. without prior hearing of Everlight. On Nov. 10, 2016, the preliminary injunctions were served on Everlight. These are preliminary measures which can still be remedied by Everlight.
Nichia seeks to protect its patents and other intellectual property rights and takes actions against alleged infringers in any country where appropriate and necessary.
