Nichia and Everlight Drag Patent War to Australia

Nichia Corporation (Nichia) has filed yet another patent infringement against Everlight Electronics (Everlight). The Japanese company recently filed legal action against the Taiwanese company’s customer Arrow Electronics Australia in the Australian Federal Court for infringing on Nichia’s YAG patent (Australian Patent No. 720234). 

Nichia is claiming damages for the infringement with regards to LED products with the respective product numbers, including 62-217D/QK2C-S5050R1R3B42Z15/2T, 62-217D/QK2C-S5757R1R3B42Z15/2T, 62-217D/QK2C-S6565R1R3B42Z15/2T, and 45-21S/KK2C-S5757L1L4B2Z3/2T. 

Everlight, however, firmly believes that the patent is invalid and that there is no patent infringement by the company’s products. Everlight will assist Arrow to defend the allegations made in the Australian Federal Court proceeding. According to a recent press release by Everlight, the Japanese Patent Office declared the entire claims of Japanese patent 4530094 invalid, and said that the Japanese patent is one of Nichia’s patent families corresponding to the Australian patent-in-suit.
