Unity Opto to Take Legal Action Against Cree

Taiwanese LED manufacturer Unity Opto Technology (Unity Opto) is planning to retaliate against Cree’s recent patent infringement lawsuit, according to a Money DJ report.

Unity Opto has consulted its lawyer team the appropriate course of actions to take in response to Cree’s recent complaint.

The lawsuit Cree filed against Unity Opto and its luminaire client Feit Electric is aiming to cause business interference. Cree has been trying to confuse the public by applying new regulations on old generation products, said Unity Opto. The U.S. LED manufacturer accused Unity Opto’s LED products did not meet Energy Star label standards, but the assessments of the older generation products were based on new regulations issued in September 2014, explained the Taiwanese manufacturer. By discrediting Unity Opto’s old generation LED products Energy Label standards and accusing the company of misleading advertisements, Cree has violated fair trade practices, said Unity Opto.

The products listed in Cree’s complaint all met old Energy Star label standards, and Unity Opto has terminated the production of these older generation products in late 2014. The company’s products all meet new Energy Star standards, therefore the company expects 2015 shipment plans will remain unaffected.

Earlier this week, Cree filed patent infringement complaints with the U.S. International Trade Commission (ITC) and the U.S. District Court for the Western District of Wisconsin against Feit Electric and its Asian supplier, Unity Opto Technology.
