Nichia has announced that WOFI (Leuchten Wortmann & Filz), Everlight’s German subsidiary has withdrawn its appeal against the judgment of the Düsseldorf District Court concerning the YAG patent EP 936 682 (DE 697 02 929) of Nichia.

In response to Nichia’s announcement of the final result of the patent lawsuit in Germany, Everlight reported that Nichia’s patent in Europe has expired in 2017 and that the result does not affect Everlight’s current products.

EVERLIGHT Electronics Co., Ltd. (EVERLIGHT) on June 10, 2017 filed a patent infringement action against Bridgelux, Inc. in the U.S. District Court for the Northern District of California. EVERLIGHT is claiming that Bridgelux infringes U.S. Patent Nos. 6,335,548 and 7,253,448 by manufacturing and selling infringing LED products, including for example the Bridgelux 2835 series.

On June 8, 2017, Seoul Semiconductor Co., Ltd. and Seoul Viosys Co., Ltd. (collectively “Seoul”) announced that they have resolved a patent litigation that was filed on behalf of Seoul and The Regents of the University of California against Kmart Corporation. The patent case was filed in U.S. Federal District Court, asserting infringement of eight patents based upon Kmart’s sales of Kodak/Spotlite branded filament LED bulbs.

On April 25, 2017, the Düsseldorf District Court in Germany has rendered judgments in favor of Nichia Corporation (“Nichia”) maintaining three preliminary injunctions against Everlight Electronics Co., Ltd. (“Everlight”) for infringement of Nichia’s YAG patent EP 936 682 (DE 697 02 929). The preliminary injunctions concern the white LED products “334-15/X1C5-1QSA”, „334-15/T2C2-1TVB“ and „XI3535-KT577J1-03201-000P“ manufactured by Everlight and distributed in Germany.

On April, 25, 2017, a Taiwanese LED manufacturer Everlight Electronics Co., Ltd. (“Everlight”) issued a press release, announcing that it had filed a patent infringement lawsuit in Tokyo District Court against Nichia Corporation (“Nichia”) and other companies.

Mitsubishi Chemical Corporation (MCC; Head office: Chiyoda-ku, Tokyo; President: Hitoshi Ochi) and National Institute for Materials Science (NIMS; Location: Tsukuba-shi, Ibaraki; President: Kazuhito Hashimoto) today announced that the Patent Reexamination Board of the State Intellectual Property Office of the P.R.C. (SIPO) has dismissed every aspect of the claim, filed on November 2, 2016, by China’s Intematix Suzhou Lighting Co., Ltd.* 1 (Intematix Suzhou Lighting), requesting for the invalidation of the Chinese patent (No. ZL201110066517.7; “the patent”* 2 ) for red phosphor, a material used extensively in light-emitting diodes (LEDs), owned by MCC and NIMS. The board approved the validity of the patent, and MCC and NIMS received the written decision effective May 10. 

Seoul Semiconductor Co., Ltd. (KOSDAQ 046890) — On April 28, 2017, Seoul Semiconductor Europe GmbH (“Seoul”) filed a patent infringement claim in Germany at the District Court of Düsseldorf against Mouser Electronic Inc. (“Mouser), a global electronic components distributor, which it accused of selling Everlight LED products.
