Everlight Compensates Nichia as Ordered by U.S. Federal Court of Michigan

Everlight pays Nichia a total of US $100,000 as a sanction ordered by the United States District Court for the Eastern District of Michigan for its violations of a previous order. The litigation is captioned Everlight Electronics Co., Ltd. and Emcore Corp. v. Nichia Corp. and Nichia America Corp., Case No. 4:12-cv-11758 GAD-MKM (E.D. Mich.). Trial in this case is scheduled for October 2014.

As reported in a prior press release, the Court granted four separate Motions that Nichia brought against Everlight for deficiencies in the litigation discovery provided by Everlight in the ongoing patent infringement lawsuit involving Everlight’s white LEDs. Concerning one of these Motions, the Court found that Everlight had breached a prior Order of the Court, that documents covered by that Order were produced late, that other documents still had not yet been produced and that there were other deficiencies. As a sanction for these violations, the Court ordered Everlight to pay US $5,000 plus Nichia’s reasonable attorneys’ fees and costs for all four Motions. It was determined that Everlight would pay Nichia a total of US $100,000.  Nichia has now received that US $100,000 payment.

As demonstrated throughout this litigation as well as other litigation currently pending in multiple jurisdictions, Nichia seeks to protect its patents and other intellectual property rights, and takes actions against infringers in any country where appropriate and necessary.
